6698 SAYILI KİŞİSEL VERİLERİN KORUNMASI KANUNU UYARINCA KİŞİSEL VERİLERİN KORUNMASI HAKKINDA AYDINLATMA METNİ 

MANUFHUB İç ve Dış Ticaret Limited Şirketi (FİRMA) tarafından kişisel verilerinizin korunmasına azami hassasiyet gösterilmektedir. MANUFHUB İç ve Dış Ticaret Limited Şirketi  tarafından www.catistanbul.com (SİTE) internet adresinden sunulan hizmetlerimizden faydalanan kişilerin her türlü kişisel ve özel nitelikli kişisel verileri, 6698 sayılı Kişisel Verilerin Korunması Kanunu’na (“KVKK”) uygun olarak işlenerek muhafaza edilmektedir.

Kişisel Veri Nedir?

Bireyleri tanınabilir veya belirlenebilir kılmaya yarayacak her türlü veri, kişisel veri olarak tanımlanmaktadır. 6698 sayısı Kişisel Verilerin Korunması Kanunu’nda kişisel veriler genel kişisel veriler ve özel kişisel veriler (hassas veriler) olmak üzere ikiye ayrılmıştır. Kimlik, banka hesap bilgileri, kredi kartı bilgileri, Internet IP Adresi ve iletişim bilgileri vb veriler Genel Kişisel Verilere örnek teşkil eder. Özel kişisel veriler (Hassas Veriler) ise; Sağlık verileri, Adli Veriler, Sabıka Kayıtları, Biometrik Veriler (Parmak izi, Retina ), Dernek/Vakıf/Sendika üyelikleri, kişinin Dini/Siyasi/Felsefi görüşleri olarak örneklendirilebilir.

Kişisel Verilerin Toplanması 

Kişisel verileriniz, FİRMA tarafından SİTE başta olmak üzere tamamen veya kısmen otomatik olan ya da herhangi bir veri kayıt sisteminin parçası olmak kaydıyla otomatik olmayan yollarla, elektronik ve/veya fiziki ortamlardan, çerezler ve sair tanımlama teknolojileri, talep/şikayet platformları, yetkili kamu kurum ve kuruluşları ile diğer ilgili 3. kişilere ait entegre sistemler ve sosyal medya ile bunlara ileride eklenebilecek sair yöntemler (kanallar) vasıtasıyla toplanmaktadır.

Kişisel Verilerin İşlenmesi ve Aktarılması

ZİYARETÇİ’lerin belirtilen koşullarda elde edilen kişisel verileri; veri sorumlusu FİRMA ile iş ortakları, halefleri, servis sağlayıcıları tarafından aşağıdaki kişisel veriler işlenebilmektedir.

• Kimlik Bilgileri: ad, soyad, cinsiyet ve yaş bilgileri, TCKN (yalnızca belli ürün gruplarını satın almanız halinde mevzuat uyarınca işlenmektedir.)
• İletişim Bilgileri: GSM numarası, teslimat adresi, e-posta adresi
• Müşteri İşlem Bilgileri: sipariş ve fatura bilgileri, teslimat işlem bilgileri, geçmiş alışverişlere dair işlem bilgisi, talep ve şikayet bilgileri,
• İşlem Güvenliği Bilgileri: IP adresi bilgisi, şifre ve parola bilgileri, çerez bilgileri,
• Hukuki İşlem Bilgileriniz: yetkili kişi, kurum ve kuruluşlarla yazışmalardaki bilgiler, dava ve icra dosyalarındaki bilgiler, yasal bilgi talebi bilgileri,
• Her türlü ürün-hizmet tanıtımı, reklam, iletişim, promosyon, satış, pazarlama, mağaza kartı, kredi kartı ve kullanıcı/üyelik/müşteri bilgilendirmeleri, işlemleri ve uygulamaları yapılması amacıyla,
• ZİYARETÇİ’nin satın aldıkları veya ilgilendikleri ürün-hizmetler ile ilgili müşteri deneyimleri, tüketici hakları, müşteri/üye hizmetleri ve bunlara ilişkin ticari-mali ve hukuki sorumluluk-yükümlülüklerin gerçekleştirilmesine dair yasal nedenlerle, 
• Kanunlarda kişisel verilerin işlenebileceği ve aktarılabileceği açıkça öngörülen hallerde, 

Veri sorumlusu/işleyen olarak her türlü hukuki yükümlülükleri yerine getirebilme için zorunlu durumlarda, ayrıca hakların tesisi, kullanılması veya korunması için veri işlemenin ve aktarmanın zorunlu olduğu durumlar ile temel hak ve özgürlüklerine zarar vermemek kaydıyla veri sorumlusu/işleyen olarak burada ve yasalarda öngörülmüş meşru menfaatler için veri işlemenin ve aktarmanın zorunlu/gerekli olduğu hallerde, kanunlara uygun sair yöntemler ile işlenebilmekte ve aktarılabilmektedir. 

Bu veriler FİRMA’nın müşterilerine sunmuş olduğu hizmetlerin en iyi koşullar altında sağlanabilmesi, ürün veya hizmetlerin güvenilir ve kesintisiz bir şekilde temin edilmesi, müşteri memnuniyetinin en üst seviyeye çıkarılması, ödemelerin yapılması, mezkur hizmetlere ilişkin çeşitli işlemlerin yapılması, pazarlama ve tanıtım faaliyetleri, müşterilerle akdedilen sözleşmelerin gereklerinin yerine getirilmesi amaçlarıyla doğrudan veya dolaylı olarak KVKK’nin 4. maddesindeki usul ve esaslara uygun olarak ve 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları dahilinde işlenmektedir.

Toplanan kişisel verileriniz; gerek genel gerekse kişiye özel imkanlardan faydalanmanız, şirketimizin veri toplama ve kaydetmeye yönelik yasal yükümlülüklerinin yerine getirilmesi ve bağlı kuruluş ve tedarikçiler ile birlikte çalışılan kamu kurum ve kuruluşları ile koordinasyonun sağlanması, insan kaynakları politikalarının yürütülmesinin temini, verilen hizmetin sürekliliğinin sağlanması amaçlarıyla, şirketimizin bağlı kuruluşları, çalışılan sigorta kuruluşları, yurt içi ve yurt dışındaki şirket ve kuruluşlar, kamu kurum ve kuruluşları ile Şirketimizle iş ilişkisi içerisinde olan özel kuruluşlar, iş ortakları, tedarikçi ve servis sağlayıcıları ve bunların belirleyeceği üçüncü kişiler/kuruluşlara KVKK’nin 8. ve 9. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları çerçevesinde aktarılabilecektir.

Kişisel Verilerin Korunması

SİTE kullanımı kapsamında ZİYARETÇİ’ler tarafından verilen ve taraflarından edinilen bilgilerin ve işlemlerinin güvenliği için gerekli önlemler, bilgi ve işlemin mahiyetine göre FİRMA veya gerekli güvenlik tedbirlerini aldırmak suretiyle yetkilendirdiği veri işleyenlerin mevcut sistemleri ve internet altyapısıyla, teknolojik imkanlar ve maliyet unsurları dâhilinde, uygun teknik ve idari yöntemlerle alınmıştır.

 KVKK Kapsamında Haklarınız

 KVKK’nin 11. maddesi uyarınca kişisel veri sahipleri;

• Kişisel veri işlenip işlenmediğini öğrenme,
• Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
• Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
• Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
• Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• KVKK’nin ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerin silinmesini veya yok edilmesini veya anonimleştirilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
• Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme haklarına sahiptir.

KVKK’nin 13. maddesinin 1. fıkrası gereğince, yukarıda belirtilen haklarınızı kullanmak ile ilgili talebinizi, info@catistanbul.com adresine güvenli elektronik imzalı olarak ya da yazılı ıslak imzalı olarak iletebilirsiniz. Şirketimiz talebin niteliğine göre talebi en geç otuz gün içinde ücretsiz olarak sonuçlandıracaktır. Ancak, işlemin ayrıca bir maliyet gerektirmesi halinde tarafımızca Kişisel Verileri Koruma Kurulu tarafından belirlenen tarifedeki ücret alınacaktır.

Privacy Notice on the Protection of Personal Data

Pursuant to the Law No. 6698 on the Protection of Personal Data

MANUFHUB İç ve Dış Ticaret Limited Şirketi (“COMPANY”) attaches the utmost importance to the protection of personal data. All personal and special categories of personal data of individuals who benefit from the services provided by MANUFHUB İç ve Dış Ticaret Limited Şirketi through the website www.catistanbul.com (“WEBSITE”) are processed and stored in accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”).

What Is Personal Data?

Any information that makes an individual identifiable or identifiable is defined as personal data. Under the Law No. 6698 on the Protection of Personal Data, personal data is classified into general personal data and special categories of personal data (sensitive data).

Examples of general personal data include identity information, bank account details, credit card information, internet IP address, and contact information.
Special categories of personal data (sensitive data) include health data, criminal records, biometric data (fingerprints, retina scans), membership of associations/foundations/unions, and an individual’s religious, political, or philosophical beliefs.

Collection of Personal Data

Your personal data is collected by the COMPANY through the WEBSITE and other channels, either fully or partially by automated means or non-automated means provided that they form part of a data recording system. Data may be collected via electronic and/or physical environments, cookies and similar identification technologies, request/complaint platforms, integrated systems of authorized public institutions and organizations, social media platforms, and other methods (channels) that may be added in the future.

Processing and Transfer of Personal Data

The personal data obtained from VISITORS under the conditions stated above may be processed by the COMPANY, acting as the data controller, as well as by its business partners, successors, and service providers, including the following categories of data:

• Identity Information: name, surname, gender, age, Turkish ID number (processed only for certain product groups as required by legislation),
• Contact Information: mobile phone number, delivery address, email address,
• Customer Transaction Information: order and invoice details, delivery transaction information, transaction history related to previous purchases, request and complaint information,
• Transaction Security Information: IP address, password and login credentials, cookie data,
• Legal Transaction Information: correspondence with authorized persons, institutions, and organizations; information contained in lawsuits and enforcement files; legal information request data,
• For the purposes of product and service promotion, advertising, communication, promotion, sales and marketing activities, store card, credit card, and user/member/customer information, transactions, and applications,
• For legal reasons related to customer experience, consumer rights, customer/member services, and the fulfillment of commercial, financial, and legal obligations regarding products and services purchased or shown interest in by the VISITOR,
• In cases where the processing and transfer of personal data is explicitly stipulated by law.

Personal data may also be processed and transferred, in compliance with the law, where it is mandatory for the fulfillment of legal obligations of the data controller/processor, for the establishment, exercise, or protection of rights, or where it is necessary for the legitimate interests of the data controller/processor, provided that it does not harm fundamental rights and freedoms.

Purposes of Processing Personal Data

These data are processed directly or indirectly in accordance with the procedures and principles set forth in Article 4 of the KVKK and within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK, for purposes including but not limited to:

• Providing services to customers under the best conditions,
• Ensuring secure and uninterrupted provision of products and services,
• Maximizing customer satisfaction,
• Processing payments,
• Carrying out transactions related to the relevant services,
• Conducting marketing and promotional activities,
• Fulfilling contractual obligations entered into with customers.

Transfer of Personal Data

Your collected personal data may be transferred, within the framework of the personal data processing conditions and purposes set forth in Articles 8 and 9 of the KVKK, for purposes such as benefiting from general or personalized services, fulfilling the COMPANY’s legal obligations regarding data collection and recording, ensuring coordination with affiliated companies, suppliers, and public institutions, executing human resources policies, and ensuring service continuity.

In this context, personal data may be transferred to the COMPANY’s affiliates, insurance companies, domestic and international companies and organizations, public institutions and organizations, private entities with which the COMPANY has a business relationship, business partners, suppliers, service providers, and third parties designated by them.

Protection of Personal Data

The COMPANY has taken the necessary technical and administrative measures, within the scope of available technological possibilities and cost considerations, to ensure the security of information and transactions obtained from VISITORS through the use of the WEBSITE. These measures are implemented either directly by the COMPANY or by data processors authorized by the COMPANY.

Your Rights Under the KVKK

Pursuant to Article 11 of the KVKK, personal data owners have the right to:

• Learn whether personal data is processed,
• Request information if personal data has been processed,
• Learn the purpose of processing personal data and whether it is used in accordance with its purpose,
• Know the third parties to whom personal data is transferred domestically or abroad,
• Request correction of personal data if it is incomplete or inaccurately processed and request notification of such correction to third parties to whom the data has been transferred,
• Request deletion, destruction, or anonymization of personal data where the reasons requiring processing no longer exist, even if it has been processed in accordance with the KVKK and other relevant laws, and request notification of such actions to third parties to whom the data has been transferred,
• Object to any result against the individual arising from the analysis of personal data exclusively through automated systems,
• Request compensation for damages in case of loss due to unlawful processing of personal data.

Exercising Your Rights

Pursuant to paragraph 1 of Article 13 of the KVKK, you may submit your requests regarding the exercise of your rights by sending a written request with a wet signature or a secure electronic signature to info@catistanbul.com.

The COMPANY will finalize such requests free of charge within a maximum of thirty (30) days, depending on the nature of the request. However, if the transaction requires an additional cost, a fee determined by the Personal Data Protection Board may be charged.
